mXrevival Official Rules

These Official Rules (“Official Rules”) govern promotional opportunities, member rewards, and prize distributions offered by mXrevival (“mXrevival,” “we,” “us,” or “our”).

By participating in any mXrevival promotional opportunity, you agree to be bound by these Official Rules and any additional rules specifically applicable to a particular promotion.

1. PURPOSE OF THE PROGRAM

mXrevival is a dirtbike-focused business dedicated to building, restoring, modifying, and showcasing motorcycles and creating entertaining content around those projects.

The mXrevival Membership program allows individuals to voluntarily support the continued operation, projects, content, and activities of mXrevival through a monthly Membership.

As a way of recognizing and rewarding members, mXrevival may provide prizes, rewards, promotional opportunities, completed dirtbikes, products, merchandise, experiences, or other items to eligible members from time to time.

2. MEMBERS ARE NOT PURCHASING A SPECIFIC PRIZE

A Member does not purchase a particular prize, dirtbike, or other item through the Membership.

Membership is not a purchase order for a dirtbike or other prize.

There is no specific item that a Member is purchasing or reserving by paying the monthly Membership fee.

Likewise, a Member’s Membership does not guarantee that the Member will receive any particular prize, dirtbike, product, cash award, or other reward.

3. MEMBERS SUPPORT mXrevival

Membership payments are intended to support the ongoing operation, projects, content creation, and activities of mXrevival.

mXrevival independently determines how Membership support is used in operating its business.

From time to time, mXrevival may choose to reward or recognize its Members through promotional opportunities, prizes, completed-bike awards, products, merchandise, experiences, or other benefits.

4. REWARDS ARE NOT GUARANTEED

Membership does not guarantee that a Member will receive a prize or reward.

The existence, frequency, type, value, and timing of Member rewards may vary.

mXrevival may provide rewards on a monthly, periodic, or other basis at its discretion, subject to applicable law and the specific rules governing the applicable promotion.

5. NO SPECIFIC ITEM IS ASSOCIATED WITH MEMBERSHIP PURCHASE

A Member does not select a particular dirtbike, prize, or other item at the time of Membership enrollment.

Membership enrollment does not create a contractual promise that the Member will receive any particular item.

For example, the fact that mXrevival may reward Members with a completed dirtbike does not mean that the Member’s $15 Membership payment constitutes payment for that dirtbike or for a specific chance to receive that dirtbike.

6. PROMOTIONAL OPPORTUNITIES

When mXrevival offers a particular promotional opportunity, mXrevival may publish additional information describing that opportunity.

Such information may include:

• The applicable promotional period;

• Eligibility requirements;

• The method by which a recipient is selected;

• The applicable prize or reward;

• The number of recipients;

• Any applicable geographic restrictions;

• Any applicable deadlines;

• How recipients are notified; and

• Other terms applicable to that specific promotion.

Those additional terms will supplement these Official Rules.

7. ELIGIBILITY

Eligibility requirements may vary depending upon the particular promotion.

Unless otherwise stated in the applicable promotion-specific rules, Members must:

• Be legally eligible to participate;

• Provide accurate account information;

• Maintain an account in good standing; and

• Comply with these Official Rules and the applicable Membership Terms.

mXrevival reserves the right to verify eligibility before providing a reward.

8. MEMBER STATUS

A person’s eligibility for a particular Member reward may depend upon whether that person maintains an active Membership at the applicable time and whether that person satisfies the requirements of the applicable promotion.

A canceled, terminated, fraudulent, or otherwise ineligible account may be excluded where permitted by the applicable rules.

9. SELECTION OF REWARD RECIPIENTS

When mXrevival provides a reward through a promotional opportunity involving a selection among eligible Members, the selection method will be disclosed in the applicable promotion-specific rules or announcement.

mXrevival may use a random selection process or another lawful selection method, depending upon the particular promotion.

No particular Member is guaranteed to be selected.

10. PRIZES AND REWARDS

Prizes and rewards may include, but are not limited to:

• Completed dirtbikes;

• Dirtbike-related products;

• Parts;

• Tools;

• Merchandise;

• Cash or cash-equivalent rewards where permitted;

• Experiences; or

• Other items determined by mXrevival.

The actual prize or reward available for a particular promotion will be identified in the applicable promotional announcement or Official Rules.

mXrevival reserves the right to substitute a prize or reward of equal or greater value when reasonably necessary and permitted by applicable law.

11. WINNER/RECIPIENT NOTIFICATION

Where a promotional opportunity involves selection of a specific recipient, the selected recipient may be contacted using the information associated with their mXrevival account.

A selected recipient may be required to provide information reasonably necessary to verify eligibility and arrange delivery or transfer of the applicable prize or reward.

Failure to respond within the applicable time period may result in disqualification and selection of another eligible recipient where permitted.

12. TAXES AND EXPENSES

Recipients are responsible for any taxes, fees, registration costs, transportation costs, insurance, or other expenses associated with accepting or using a prize or reward unless expressly stated otherwise.

Recipients are responsible for determining and satisfying their own tax obligations.

13. DISQUALIFICATION

mXrevival reserves the right to disqualify any individual who:

• Provides false or misleading information;

• Attempts to manipulate or interfere with the promotional process;

• Uses fraudulent means to participate;

• Violates these Official Rules;

• Violates the applicable Membership Terms; or

• Engages in conduct that mXrevival reasonably determines is intended to improperly interfere with the program.

14. PROGRAM MODIFICATION

mXrevival reserves the right to modify, suspend, or discontinue a promotional opportunity when permitted by applicable law.

Any modification will not retroactively alter rights that have already vested where prohibited by applicable law.

15. NO GUARANTEE OF ANY PARTICULAR REWARD

Nothing in these Official Rules guarantees that any particular Member will receive a reward.

The decision to provide rewards, the nature of those rewards, and the timing of those rewards may vary.

Membership should not be purchased with an expectation of receiving any particular prize.

16. RELATIONSHIP TO MEMBERSHIP TERMS

These Official Rules govern promotional opportunities and Member rewards.

The mXrevival Membership Terms & Conditions govern the Membership itself, including the $15.00 recurring monthly Membership fee, automatic renewal, cancellation, billing, and refunds.

Members should review both documents before participating.

17. COMPLIANCE WITH APPLICABLE LAW

mXrevival intends to operate its Membership and promotional programs in compliance with applicable federal, state, and local laws.

Nothing in these Official Rules is intended to waive or limit any rights or protections that cannot legally be waived or limited.

If any provision of these Official Rules is determined to be invalid or unenforceable, the remaining provisions will remain in effect to the maximum extent permitted by law.

18. ACCEPTANCE

By maintaining an mXrevival Membership and participating in a Member promotional opportunity, you acknowledge that you have had an opportunity to review these Official Rules and agree to comply with the applicable rules governing the program.

IMPORTANT PROGRAM DISCLOSURE

mXrevival MEMBERSHIP IS A $15.00 MONTHLY MEMBERSHIP THAT SUPPORTS THE mXrevival BUSINESS, ITS PROJECTS, AND ITS CONTENT.

MEMBERSHIP DOES NOT CONSTITUTE THE PURCHASE OF ANY SPECIFIC DIRTBIKE, PRIZE, OR OTHER ITEM.

mXrevival MAY, FROM TIME TO TIME, REWARD OR RECOGNIZE MEMBERS WITH PRIZES, COMPLETED DIRTBIKES, PRODUCTS, OR OTHER REWARDS, SUBJECT TO THE APPLICABLE RULES.

NO PARTICULAR PRIZE OR REWARD IS GUARANTEED TO ANY MEMBER.

Members should not purchase a Membership with the expectation of receiving any particular prize or reward.
