OFFICIAL RULES ("Rules")

NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN. A PURCHASE OR PAYMENT WILL NOT IMPROVE YOUR CHANCES OF WINNING. A FREE ALTERNATIVE METHOD OF ENTRY IS AVAILABLE FOR EVERY GIVEAWAY (SEE "HOW TO ENTER" BELOW). VOID WHERE PROHIBITED.

Overview

mXrevival Monthly ("Membership," "Program," or "Giveaway") is an ongoing promotion in which eligible participants are entered into recurring giveaways for MX products and for custom motorcycle builds. Membership is offered by mXrevival ("Sponsor") for a recurring fee of $15.00 USD per month, but paid Membership is not required to enter or win. Any eligible person may enter each individual giveaway free of charge using the Free Alternative Method of Entry described below, and will receive the same number of entries into that giveaway as a paid Member.

These Rules govern only the recurring giveaways included with mXrevival Monthly. These Rules do NOT govern "Raffle Style" limited-slot giveaways (such as the 2008 RMZ450 Build), which are sold in a fixed number of entry slots and are governed by their own separate Official Rules. Raffle Style giveaways are expressly excluded from mXrevival Monthly.

Who Can Enter

mXrevival Monthly is open to legal residents of the fifty (50) United States and the District of Columbia, to legal residents of Canada (excluding Quebec), and to legal residents of other countries worldwide, who are 18 years of age or older (or the age of majority in their jurisdiction, whichever is greater) on the date of entry. The Giveaway is void where prohibited or restricted by law and is subject to all applicable federal, provincial, state, local, and national laws and regulations, including the laws of the entrant's own country. It is each entrant's responsibility to ensure that participation is lawful in their jurisdiction; entrants located in any country where the Giveaway is prohibited, restricted, or would require Sponsor to register, obtain a license, or take other regulatory action are not eligible. International winners are subject to additional prize, shipping, cost, and forfeiture terms — see "International Winners (Outside the U.S. and Canada)" below.

Employees, officers, directors, contractors, and agents of Sponsor and of any individual giveaway's prize sponsor(s), and their respective affiliates, subsidiaries, advertising and promotion agencies, and suppliers, and the immediate family members (parent, child, sibling, spouse) and/or those living in the same household of each, are not eligible to participate. Membership in the Program is personal to the entrant and is non-transferable.

You Agree to the Rules

By participating, you agree to be bound by these Rules and by the decisions of Sponsor, which are final and binding in all matters relating to the Giveaway. You represent and warrant that you meet the eligibility requirements set forth herein.

Program Structure & Giveaway Types

mXrevival Monthly includes two (2) types of recurring giveaways (each, a "Covered Giveaway"):

1. Monthly Product Giveaways — brand-new MX parts, products, and services (for example, tires, decal/graphics kits, handlebars, bolt kits, coatings, vapor blasting, suspension service, and shop tools). One or more Monthly Product Giveaways may run in a given calendar month.

2. Bike Build Giveaways — one (1) custom mXrevival motorcycle build per applicable giveaway ("Grand Prize"). Bike Build Giveaways run on the schedule set and announced by Sponsor.

Each Covered Giveaway has its own entry period ("Entry Period"), which opens when Sponsor announces that giveaway (typically upon publication of its corresponding YouTube video as "Public" and/or announcement on Sponsor's website or social media) and closes on the date and time stated by Sponsor for that giveaway ("Drawing Date"). Sponsor will announce each Covered Giveaway on one or more of its platforms: www.mXrevival.com, and mXrevival's Facebook, Instagram, TikTok, and/or YouTube channels.

"Raffle Style" limited-slot giveaways are not Covered Giveaways and are not included with Membership.

How to Enter

There are two (2) ways to receive entries into a Covered Giveaway. Both methods receive the same number of entries per Covered Giveaway: one (1) entry per person, per Covered Giveaway.

​

1. Membership Entry (Paid). During any period in which your paid Membership is active and in good standing, you are automatically entered into each Covered Giveaway whose Entry Period is open during your active paid Membership. You will receive one (1) entry into each such Covered Giveaway. No further action is required. If your Membership is not active during a Covered Giveaway's Entry Period, you will not be automatically entered into that giveaway (but you may still enter it for free using the method below).

​

2. Free Alternative Method of Entry (AMOE — No Payment Necessary). To enter any Covered Giveaway without paying, legibly hand-print your full name, complete street address, city, state/province, ZIP/postal code, country, telephone number, complete email address, and the name of the specific Covered Giveaway you wish to enter on a standard 4" x 6" postcard, with no outer envelope, and mail it with sufficient postage to:

Each valid postcard receives one (1) entry into the one (1) Covered Giveaway named on that postcard, equal to the entry a paid Member receives for that same giveaway. To enter more than one Covered Giveaway, mail a separate postcard for each; each postcard must be hand-printed separately, mailed separately with no outer envelope, and bear sufficient postage. Limit one (1) AMOE entry per person, per Covered Giveaway. Your postcard must be received by Sponsor before the applicable Covered Giveaway's Drawing Date to be eligible for that giveaway.

Sponsor assumes no responsibility for lost, late, misdirected, stolen, illegible, inaccurate, damaged, incomplete, non-delivered, or postage-due mail, or for any failure or unavailability of electronic equipment, communications, or Internet connections, or other errors, failures, or malfunctions of any kind. All entries become the exclusive property of Sponsor and will not be acknowledged or returned. By entering via either method, you consent to receive email announcements from Sponsor in accordance with its Privacy Policy at www.mXrevival.com; you may unsubscribe at any time without affecting your chances of winning. You are not a winner until your prize claim is validated and you receive official written notification from Sponsor. In the event of a dispute regarding the identity of an entrant, the entry will be deemed made by the authorized holder of the email address and/or account used to enter, or by the person named on the postcard.

Loyalty Cash Bonus (Paid Membership Benefit)

As a benefit of paid Membership, a winner of a Bike Build Giveaway Grand Prize who is an active, paid Member in good standing at the time of the drawing will also receive a Loyalty Cash Bonus equal to $100.00 USD for each consecutive full calendar month of paid Membership completed immediately prior to the applicable Drawing Date, up to a maximum of $3,600.

The Loyalty Cash Bonus is a loyalty reward tied to completed paid Membership months and is separate from the Grand Prize itself. The Grand Prize (the custom motorcycle build) is identical for all winners regardless of how they entered. Entrants who enter a Bike Build Giveaway via the Free Alternative Method of Entry are fully eligible to win the identical Grand Prize but do not accrue paid Membership months and therefore do not receive the Loyalty Cash Bonus. Consecutive months are counted only for uninterrupted, successfully billed Membership periods; a lapse, cancellation, failed payment, or refund resets the count to zero. The Loyalty Cash Bonus, if any, is paid at Sponsor's discretion by a method Sponsor selects and is subject to all conditions and tax obligations described under "Prizes" below.

Anti-Fraud & Specific Conditions

Any incomplete or illegible entries will not be processed. The use of automated, robotic, macro, scripted, or pre-programmed entries is strictly prohibited. Any attempt to obtain more than the stated number of entries — including by using multiple or different email addresses, accounts, identities, registrations, logins, payment methods, devices, or IP addresses, or by creating multiple Memberships in an attempt to receive multiple entries into the same Covered Giveaway — may void all of that participant's entries, and that participant may be disqualified at Sponsor's sole discretion. Use of any automated system to participate is prohibited and will result in disqualification. Sponsor is not responsible for lost, late, incomplete, invalid, unintelligible, or misdirected entries, which will be disqualified. No entries will be accepted from or on behalf of corporations, trusts, partnerships, or other entities. Except as expressly permitted herein, no transfer or assignment of any entry or Membership is permitted.

Prizes

Prizes vary by Covered Giveaway and are determined solely by Sponsor. Monthly Product Giveaway prizes consist of the MX product(s) or service(s) described by Sponsor for that giveaway. Bike Build Giveaway Grand Prizes consist of one (1) customized mXrevival motorcycle build as described by Sponsor for that giveaway, plus, for eligible paid Members, the Loyalty Cash Bonus described above. Actual or appraised value may differ at the time of award, and the specifications of any prize are determined solely by Sponsor.

Prizes will be delivered by email, by mail/parcel carrier, or by freight method selected by Sponsor, as appropriate to the prize. No cash or other substitution of any prize is permitted except at Sponsor's sole discretion. Prizes are non-transferable. Any and all prize-related expenses — including without limitation all federal, state, provincial, local, and national taxes; customs duties, import fees, permits, and procurement costs applicable to the winner's country; and any shipping or freight fees not expressly stated as covered by Sponsor — are the sole responsibility of the winner. For Bike Build Giveaway Grand Prizes, additional international shipping and forfeiture terms apply as set forth in "International Winners" below. Acceptance of a prize constitutes permission for Sponsor to use the winner's name, likeness, and entry for advertising and trade purposes without further compensation, unless prohibited by law.

International Winners (Outside the U.S. and Canada)

mXrevival Monthly is open to eligible participants worldwide, subject to the following additional terms for winners who reside outside the United States and Canada ("International Winners"):

Shipping is the International Winner's responsibility. For any motorcycle or other freight-shipped prize, Sponsor's shipping obligation, if any, extends only to a U.S. port or export point designated by Sponsor. The International Winner is solely responsible for arranging, coordinating, and paying for all transport of the prize from that U.S. port to their location, and for all associated costs, including without limitation international freight, insurance, customs duties, import taxes, tariffs, brokerage, permits, homologation or compliance requirements, and any other fees required to import or take possession of the prize in their country. Sponsor will not be responsible for any monetary amount required to procure, export, import, or deliver an International Winner's prize, in any capacity, and makes no representation that any prize can be lawfully imported or registered in the winner's country.

Time to claim and coordinate. An International Winner of a Bike Build Grand Prize must contact Sponsor, accept the prize, and demonstrate the ability to pay for and coordinate international shipping within sixty (60) days of the date award notification is sent. Failure to do so within that period constitutes forfeiture of the prize.

Forfeiture and membership-fee refund option. If an International Winner of a Bike Build Grand Prize is unable or unwilling to pay for and coordinate international shipping of the prize, that winner may elect, in lieu of the prize, to receive a refund of all monthly Membership fees that winner has actually paid to Sponsor under mXrevival Monthly. Electing or receiving this refund constitutes full and final forfeiture of the prize and of any Loyalty Cash Bonus, and a release of any further claim to the prize. Upon such forfeiture (or upon forfeiture for failure to timely claim or coordinate shipping as described above), Sponsor will select a new eligible winner for that Grand Prize from among the remaining eligible entries, under the same procedures described in these Rules. This refund option applies only to International Winners of Bike Build Grand Prizes and is the sole remedy available in these circumstances; it does not apply to domestic (U.S. and Canada) winners or to Monthly Product Giveaway prizes.

Odds

The odds of winning any Covered Giveaway depend on the number of eligible entries received for that giveaway. Because each eligible participant receives one (1) entry per Covered Giveaway regardless of entry method, paid Members and free (AMOE) entrants have the same odds of winning any given Covered Giveaway.

​

Selection & Notification of Winners

Winners of each Covered Giveaway will be selected in a random drawing from all eligible entries received for that giveaway, conducted under the supervision of Sponsor on or after that giveaway's Drawing Date. Winners will be posted and/or announced on one or more of Sponsor's platforms and notified using the contact information associated with the entry within five (5) days following winner selection. Sponsor has no liability for a winner's failure to receive notice due to spam or security settings or due to incorrect or non-functioning contact information provided by the entrant. If a selected winner cannot be contacted, is ineligible, fails to claim the prize within fifteen (15) days from the time notification was sent (or, for International Winners of a Bike Build Grand Prize, within the sixty (60)-day period described under "International Winners"), or fails to timely return any required declaration and release, the prize may be forfeited and an alternate winner selected. Receipt of any prize is conditioned upon compliance with all applicable federal, state, provincial, and local laws. Any violation of these Rules by a winner (at Sponsor's sole discretion) will result in that winner's disqualification, and all privileges as a winner will be immediately terminated.

Membership Billing, Renewal & Cancellation

Paid Membership is billed at $15.00 USD per month and automatically renews each month until cancelled. You may cancel your Membership at any time through your account or by contacting Sponsor; cancellation stops future billing and future automatic entries but does not retroactively remove entries already made while your Membership was active. Except where required by law, payments are non-refundable, including for partial months, and no proration is provided. A failed or reversed payment ends your active paid Membership and stops automatic entry until Membership is restored. Cancelling or losing paid Membership does not affect your ability to enter any Covered Giveaway for free using the Alternative Method of Entry. Sponsor may change the Membership price on a going-forward basis with notice as required by applicable law.

Rights Granted by You

By entering, you understand that Sponsor, and anyone acting on its behalf, and its respective licensees, successors, and assigns, will have the right, where permitted by law and without further notice, review, consent, or compensation, to print, publish, broadcast, distribute, and otherwise use worldwide, in any media now known or later devised and in perpetuity, your entry and (if you win) your name, likeness, image, voice, and biographical information, and statements about the Giveaway, for news, publicity, advertising, trade, public relations, and promotional purposes.

Reservation of Rights

Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify, or suspend the Program or any Covered Giveaway if a virus, bug, unauthorized human intervention, fraud, or other cause beyond its reasonable control corrupts or affects the administration, security, fairness, or proper conduct of the Program. In such an event, Sponsor may select winners from all eligible entries received prior to and/or after the action taken. Sponsor reserves the right, in its sole discretion, to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the Program or website, or who violates these Rules. Any attempt by any person to deliberately damage any website or undermine the legitimate operation of the Program may violate criminal and civil law, and Sponsor reserves the right to seek damages to the fullest extent permitted by law.

Limitation of Liability

By entering, you agree to release and hold harmless Sponsor and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers, and directors from any liability, illness, injury, death, loss, litigation, claim, or damage that may occur, directly or indirectly, whether caused by negligence or not, arising from: (i) such entrant's participation in the Program and/or acceptance, possession, use, or misuse of any prize or portion thereof; (ii) technical failures of any kind; (iii) the unavailability or inaccessibility of any transmissions, telephone, or Internet service; (iv) unauthorized human intervention in any part of the entry process or the Program; or (v) electronic or human error in the administration of the Program or the processing of entries.

Disputes

This Program is governed by the laws of the United States of America and the State of Idaho, without respect to conflict-of-law doctrines. As a condition of participating, participant agrees that any and all disputes that cannot be resolved between the parties, and all causes of action arising out of or connected with this Program, shall be resolved individually, without resort to any form of class action, exclusively before a court located in Idaho having jurisdiction. Further, in any such dispute, under no circumstances will a participant be permitted to obtain awards for, and participant hereby waives all rights to claim, punitive, incidental, or consequential damages, including reasonable attorneys' fees, other than participant's actual out-of-pocket expenses (i.e., costs associated with entering this Program), and participant further waives all rights to have damages multiplied or increased.

Privacy Policy
